A man arrested and charged for having sex in public last month in Kona has allegedly been caught with his pants down again — this time in Hilo with a different partner.
Police say 35-year-old Dylan Trask Whelden and 45-year-old Yvette R. Butterfield were engaged in sexual intercourse on the Bayfront soccer field extension on Kamehameha Avenue near Ponahawai Street near downtown Hilo when they were arrested early Saturday afternoon.
According to a police spokeswoman, Whelden was drinking malt liquor and Butterfield was consuming wine in public, as well. She noted that the soccer field extension is considered a county park and other members of the public were using the facility.
Both were arrested for and initially charged with open lewdness and public drinking, according to a police log.
Prosecutors declined to prosecute Whelden the liquor violation, but the open lewdness charge charge for both Whelden and Butterfield stand, as does the liquor charge against Butterfield. Open lewdness is a petty misdemeanor punishable by up to 30 days in jail and a fine of up to $1,000, while public drinking is a violation of a county ordinance and punishable by a fine up to $500.
Butterfield’s bail was set at $2,000 and Whelden’s at $1,000. Both were scheduled for initial appearances Monday in Hilo District Court.
Whelden was also arrested on July 16 in Kailua-Kona for having sex in public.
Police said at the time that Whelden and 33-year-old Margaret Manza of Kailua-Kona were having sex on a sidewalk fronting a Kaiwi Street business building in the old Kona Industrial Area when they were arrested shortly after 4 p.m. Monday.
The police spokeswoman said Manza allegedly spit and cursed at one of the arresting officers.
Whelden was charged with open lewdness, while Manza was charged with open lewdness, disorderly conduct, harassment and theft.
The theft charge was for allegedly stealing a $2 blouse from the Salvation Army Ohana Thrift Store. In addition, she was charged with contempt of court and failure to appear.
