HONOLULU (AP) — A company has again failed to convince the courts it should build rail cars for the Honolulu train system.
The Hawaii Intermediate Court of Appeals on Wednesday ruled that Bombardier Transportation (Holdings) USA Inc.’s argument to win the contract does not answer city requirements.
The city in March 2011 rejected Bombardier’s rail proposal. It instead awarded a $1.4 billion contract to Ansaldo Honolulu JV to build 80 rail cars as well as design, build and run the train operating system for the 20-mile rail line.
At issue were discussions over changes in the legal liability requirement sought by Bombadier.
The appeals court ruled that he city had met its obligation because it had warned Bombadier it was unwilling to change the requirement.
