HAGATNA, Guam (AP) — Guam’s labor department has denied workers’ compensation to the families of five kayak tour company workers who were swept out to sea and killed in 2004.
The Workers’ Compensation Commission under the department concluded that the incident was not work-related. The compensation would have been worth as much as $100,000 per family.
The employees of Guam Seawalker Tours were out on kayaks, prepping for the next day of business after a tropical storm had passed. High surf advisories were in effect and the ocean was still rough.
A lawyer for the families says one of the men fell out of a kayak and the others were trying to rescue him.
