A 70-year-old Captain Cook man has been indicted by a Kona grand jury for second-degree forgery.
According to police, Gerald Tamotsu Nishihara forged another person’s signature on a check and deposited it into his bank account on Jan. 7. The indictment states the check’s amount as $14,979.91.
Second-degree forgery is a Class C felony punishable by up to five years imprisonment.
A bench warrant set Nishihara’s bail at $2,000 and ordered him to have no contact with Tessie Cantor. Court records indicate that on Sept. 17, Kona attorney Robert D.L. Kim filed a complaint for an interpleader against Cantor on behalf of Nishihara in Kona Circuit Court.
An interpleader is a civil procedure brought by a third person to to have a court determine the ownership rights of rival claimants to the same money or property.
