HONOLULU (AP) — A Hawaii appeals court affirmed Honolulu’s plans to expand a dump, trumping a challenge to the city’s environmental impact statement.
U.S. Rep. Colleen Hanabusa said she is considering appealing again to the Hawaii Supreme Court. Hanabusa challenged the plans for Waimanalo Gulch Sanitary landfill while she was a state senator representing Waianae.
The landfill is Oahu’s only municipal and solid-waste dump. Hanabusa has said she wants the dump closed or relocated.
Hanabusa contended in the lawsuit that the environmental impact statement filed by the city covered less than half the 200 acres the city planned to use for the dump. The state Land Use Commission approved a permit request for the plans in 2009.
The intermediate court ruled last week that the project was properly described.
Hanabusa said the decision was “very troubling.”
“It allows government to change midway through and then play a game as to how large the landfill’s going to be,” Hanabusa said.
Donna Leong, a lawyer for the city, said the environmental impact statement was compiled in good faith.
