A Kona grand jury has indicted a 36-year-old Ka‘u man with attempted second-degree murder for an assault on his 42-year-old sister earlier this month that reportedly almost killed her.
The five-count indictment dated Monday also charges Samuel Smith of Ocean View with second-degree assault, domestic abuse and two counts of terroristic threatening.
A bench warrant set Smith’s bail at $500,000 and ordered him to have no contact with his sister, family friend Jeffrey Plate and others. It also orders him to obtain mental health and substance abuse assessment.
According to a police spokeswoman, officers responded to a 9:51 a.m. call on Aug. 8 to Orchid Parkway in Ocean View. Smith allegedly attacked his sister with a fire extinguisher and a rock, and the 34-year-old Plate was allegedly assailed when he attempted to intervene.
Abalone Smith was taken to Kona Community Hospital where she was originally listed in critical condition. Her current status is not known.
Plate was also injured but declined medical treatment. Smith was arrested at the scene and originally charged with first-degree assault, first-degree terroristic threatening and domestic abuse. His bail was originally set at $8,000.
He was not in custody as of early Friday evening, according to an official at Hawaii Community Correctional Center.
According to court records, in 2007, Smith pleaded guilty to a misdemeanor terroristic threatening charge and was granted a deferred acceptance of his plea, which means the conviction was erased from his record.
A conviction for attempted second-degree murder carries a mandatory sentence of life without the possibility of parole.
