HONOLULU (AP) — A man suspected of stealing a Pearl City car with a toddler inside will not be charged with kidnapping.
Prosecutors charged 24-year-old Erick Butner with car theft but not kidnapping because he didn’t know there was a child in the car.
Prosecutors say that without intent, he can’t be charged with kidnapping.
Christian Ibarra is the father of the 3-year-old. He says he left his black Lexus running Monday morning, ran into his house for a minute and saw someone drive away.
The car reached an intersection and was blocked by traffic and construction workers.
The driver tried to flee. Construction workers saw Ibarra running after the car and restrained the driver until police arrived.
Butner is jailed with bail set at $30,000.
