A judge has declined to release from jail a 60-year-old Keaau man accused of sexually assaulting an elderly family member.
According to court records, Deputy Public Defender Jauwon Barron on Monday requested that Hilo District Judge Jeffrey Hawk grant supervised release — a form of cashless bail — to Troy Young.
Deputy Prosecutor Georgia Berrenberg objected and requested that Hawk maintain Young’s bail at $10,000, which Hawk did.
The judge also ordered Young to return to court Wednesday for a preliminary hearing.
Young was originally booked for a single count of second-degree sexual assault, but prosecutors later increased the charged to first-degree sexual assault and added an additional charge of attempted first-degree sexual assault.
Both charges are Class A felonies, which carry a maximum sentence of 20 years imprisonment.
According to court documents filed by police, the alleged incident occurred at a residence in the Orchidland Estates subdivision in Puna.
The victim is an 88-year-old woman who is mentally incapacitated. According to court documents, the victim has been diagnosed with dementia and is mentally incapable of consent.
Young remains in custody at Hawaii Community Correctional Center.
