A Kona grand jury has indicted two men in unrelated cases, one for allegedly sexually molesting an underage girl, and another for allegedly attempting to entice an underage girl for sex.
An 11-count indictment dated June 10 charges Alfred Kamaka III of Kailua-Kona with four counts of first-degree sexual assault, six counts of third-degree sexual assault and a single count of second-degree endangering the welfare of a minor.
According to the indictment, the victim — identified only by initials — was born in 1997, and the alleged offenses occurred on July 22 and 23, 2012.
First-degree sexual assault involves “sexual penetration” and is a Class A felony punishable by up to 20 years imprisonment, while third degree sexual assault involves “sexual contact” and is a Class C felony punishable by up to five years in prison. Second-degree endangering the welfare of a minor is a misdemeanor punishable by up to a year in jail.
A bench warrant issued with the indictment set Kamaka’s bail at $100,000 and orders that he have no contact with the girl, her family or household members and that he stay at least 100 yards away from her, her home and school.
A separate three-count indictment charges 32-year-old Andrew Rodriguez of Ocean View with attempted first-degree electronic enticement of a child, promoting pornography for minors and use of a computer in the commission of a separate crime.
According to the indictment, the alleged offenses occurred between Aug. 28, 2010, and Oct. 12, 2010.
The document alleges that Rodriguez used a computer to ask the girl, identified by initials, to meet with him “with the intent to promote or facilitate the commission of a felony, sexual assault in the first-degree” and went “to the agreed upon meeting place at the agreed upon meeting time … .”
The indictment also states that Rodriguez used a computer to “to identify, select, solicit, persuade, coerce, entice, induce and/or procure the victim and/or intended victim of the offense of promoting pornography for minors” and that he “disseminated” pornography to a minor.
First-degree electronic enticement of a child and use of a computer in the commission of a separate crime are Class B felonies punishable by up to 10 years in prison, and promoting pornography for minors is a Class C felony punishable by up to five years in prison.
A bench warrant issued with the indictment set Rodriguez’s bail at $10,000 and orders that he have no contact with the girl, her family or household members and that he stay at least 100 yards away from her, her home and school.
This is the second indictment on sex-related charges involving a minor in less than three months for Rodriguez. On March 11, a Kona grand jury indicted him with first-degree sexual assault and attempted first-degree sexual assault of another girl, identified by her initials, born in 1998. The document alleges the acts occurred between July 1, 2007, and June 30, 2008.
A bench warrant in that case set his bail at $10,000 and ordered him not to contact the girl or her family.
Court records indicate that he has not been arrested nor has he made a court appearance on the March charges, which are both Class A felonies punishable by up to 20 years in prison.
Neither Kamaka nor Rodriguez are listed in the state’s sex offender registry.
