The Office of the County Prosecutor has declined to prosecute the son of Corporation Counsel Lincoln Ashida on a misdemeanor domestic abuse charge.
A motion filed by Deputy Prosecutor Mike Kagami and approved Nov. 2 by Hilo Family Court Judge Anthony Bartholomew stated that the office had a conflict of interest and “this matter will be referred to the Attorney General’s Office.”
According to a police log, Scott Tetsuro Ashida, 18, was arrested at the family’s home and charged on Nov. 1. He was released on $1,000 bail.
According to court documents, the victim is his younger sister, a minor.
Ashida, a former deputy prosecutor, lost a close race to Mitch Roth to be the next county prosecutor. A conflict would have arisen had Ashida won the contest.
Roth, who takes office in December, said Wednesday that he will let the state Attorney General’s Office handle the case.
