Suit: Autistic teen raped classmate
HONOLULU (AP) — An autistic high school student raped a classmate while the adult assigned to monitor him was taking a nap, said a federal lawsuit accusing Hawaii’s statewide school district of negligence.
The autistic student had a full-time one-on-one aide because he was known to be violent, the lawsuit filed Monday said. The aide was asleep when the 2012 attack happened during Pearl City High School band practice, the lawsuit said.
The 10th-grade girl was in the back of the band at the percussion section when the larger 11th-grader raped her there and then again in a curtained area of the auditorium.
The aide was sleeping in the audience section of the auditorium, the lawsuit said.
The girl reported the rape to her mother and police, said her attorney Peter Hsieh. The autistic student was prosecuted in family court and convicted of two counts of first-degree sexual assault, Hsieh said.
Judge OKs adding imam to state’s travel ban lawsuit
HONOLULU (AP) — A federal judge is allowing Hawaii to file an amended lawsuit challenging President Donald Trump’s travel ban.
U.S. District Court Derrick Watson ruled Monday that lawyers representing the state can file the amended lawsuit adding the Muslim Association of Hawaii’s imam as a plaintiff. According to court documents the mother-in-law of Ismail Elshikh is a Syrian national living in Syria.
Watson previously suspended the case while a nationwide injunction on the travel ban remains in place.
The state asked Watson last week to partially lift the stay to file the amended lawsuit detailing the effect the ban would have on Elshikh’s family and others in Hawaii.
